Not neccesarily, it could just be someone trying to protect themselves since you tried to steal a DS and then you punched the guy in the face. Probably would only shoot you if you tried to attack him again.

All he has to do is pull a trigger, you have to get close enough to punch him and hit him, and grab the gun push it out of the way while trying to take it all before he does something that takes less than a second to do 8).
