So if I read 398 right Itachi was acting on orders by the 3rd to kill his clan? So that would mean even the 3rd couldnt touch the uchiha in strength or he knew itachi was so honor bound he would do it

No, it just means that the Uchiha were probably a threat to Konoha as a whole. If the Third found out that they had summoned the Kyuubi, the gauntlet had been thrown.

I assumed everybody knew that there wasn't a chapter this week for any Shonen Jump mangas (Golden Week I believe).
