First, like he is doing them, he'll get Sasuke to detest Konoha and swear revenge on Konoha, then recruit him as a member of Akatsuki, and then make Sasuke capture the Nine-Tails as a test of his worth and loyalty.

There's always the chance that even Toubi was fooled. =/

After using all those Mangekyou techniques in one day, it seems impossible that it didn't drain all of his chakra.

Kakashi states that death would be the worst-case scenario if this were to happen, Itachi is a perfect example of this.
