The Uchiha clan must've been the ones to unleash the Kyuubi, with or without Madara's involvement. Which would imply the prescence of other Mangekyou users...which in turn goes right back to the issue of "Just how much did Fugaku know about Mangekyou Sharingan?". I mean, the place where the scroll is kept is the clan's "meeting place"- Wouldn't that mean that they all congregate there on occasion? If so, it's likely a few of them obtained Mangekyou Sharingan. Hell, maybe Fugaku was one of them.
