He IS Hitokugutsu, but it was said that he turned everything EXCEPT his heart artificial. Meaning he doesn't have lungs, meaning he doesn't breathe, meaning he can't take in the C4. Ever noticed that Sasori never panted in any of the panels during his fight?

And, again, he can fly, so he can avoid the C4.
