If you want any Rare Game besides DK 64 then you could be waiting a while since Rare is owned by Microsoft and so they own games like Conker, Banjo Kazoo, Diddy Kong Racing,
Jet Force Gemini, Goldeneye and Perfect Dark.
I odnt get whats going on but for some reason Nintendo keeps making Banjoo games on the GB and is making a new Diddy Kong Racing game (or its just a remake) for the DS

Nintendo don't own or make the Banjo games nor did they make the Diddy Kong Racing game but they allowed Rare to use their Diddy character.
But answering your question:
- Rare are allowed to make games for the Nintendo DS and GBA systems. Microsoft only own the rights to Rare for making console games but not handheld games.
- Nintendo own and created the character Diddy. Rare own the characters other than Diddy in Diddy Kong Racing.
So if you put two together. Rare can make games for the DS, and Nintendo own the rights to Diddy so they are remaking Diddy Kong Racing for the DS.
As for Virtual Console games, there is only a slim chance. Rare said they would allow their games which did not appear on any other systems other than Nintendo to be put on VC if Microsoft let them. But games like Conker's Bad Fur Day, Banjo Kazooie and Perfect Dark are ruled out as they are on the Xbox and Xbox 360. Goldeneye is ruled out aswell as EA own the rights to James Bond games now and would not allow Rare to have Goldeneye on VC also seeing as EA made the sequel "Goldeneye: Rouge Agent.". Donkey Kong 64, Jetforce Gemini, Diddy Kong Racing and games like Battletoads for the SNES all have a good chance especially Donkey Kong 64 as Nintendo own and created the characters in that game.
